Essex County Clerk Property Records

The Essex County Clerk's Office is the official recorder of land documents in the county. The office is at 7559 Court Street, Elizabethtown, NY 12932. Phone: (518) 873-3600. Hours are Monday through Friday.

Recording fees follow the state statutory schedule. The base fee is $45 plus $5 per page. Additional charges apply for transfer taxes and required forms. The TP-584 form costs $5. The RP-5217 fee is $125 for residential or farm property, $250 for other types. Copy fees are $1 per page. All documents must be acknowledged before a notary or authorized officer under Real Property Law Section 294.

eRecording is available for submitting documents electronically. Public access terminals are set up in the office for searching grantor and grantee indexes at no cost. Under Real Property Law Section 291, the Clerk maintains alphabetical indexes of all recorded instruments. Recording gives constructive notice under Section 293. Historical records in Essex County date to 1799. The Clerk does not do title searches. You need a title company or attorney for that.

Under Section 292, an unrecorded conveyance is void against a later good faith purchaser who records first. This is why recording with the Essex County Clerk is critical after any property transfer. The Clerk endorses each document with the date and time received and the book and page where it was filed, as Section 319 requires.

The Essex County Real Property Department maintains tax maps and assessment rolls for all municipalities in the county. Assessment rolls are public. They list each parcel with its assessed value, property class code, exemptions, and owner information.

Tax maps are updated when new subdivisions get recorded or boundaries change. The department provides support to local assessors in each town. Equalization rates are calculated annually and reported to the state for fair tax distribution. Sales data from recorded deeds is collected to help track market values and assess properties at levels close to fair market value.

Under Real Property Tax Law Article 5, tentative assessment rolls are published each spring with a grievance period. Property owners in Essex County can file complaints with Boards of Assessment Review. If the board does not resolve the issue, judicial review through an Article 7 proceeding in Supreme Court is available. Exemptions under Article 4 include STAR, veteran, senior citizen, agricultural, and other programs. Applications must be filed with the local assessor by March 1 each year.

The STAR program provides school tax relief for Essex County homeowners. Basic STAR applies to all primary residences with qualifying income. Enhanced STAR is for homeowners age 65 and older with income under the statutory limit. New homeowners register with the Department of Taxation and Finance to receive STAR credits.
